Preliminary Note

We run a German enterprise and are subject to German law. So the terms and conditions of business are written in German language. I.e. the contractual language is German/deutsch, applicable law is german law, place of jurisdiction is München / Munich (Deutschland / Germany).

All prices and delivery conditions, as well as statements concerning included taxes, warranty, right of return, and similar information that is published on this website (www.florian-anwander.de) is valid only for deliveries to Germany. For orders from outside of Germany I can provide only terms that are written in english on this website (www.florian-anwander.de).

Attention! These terms are valid only if you order from me directly. If you order from a representative or dealer the business terms of the representative or dealer are valid!

Translation of the most important sections of the terms of business (right to return, special designs and warranty conditions):

Prices
All price quotations in the price lists for end consumers are in Euro (€) net; you hav to add the respective national value added tax within the EU, plus packaging and shipping costs - unless otherwise stated. Customers outside the EU have to add packaging and shipping. The national VAT will be drawn by your national customs authority.
All prices are non-binding. The prices valid on the day of invoicing apply. Subject to prior sale, price changes and errors.

Payment
All deliveries are made by advance payment. Delivery against prepayment will only be made when the full invoice amount has been credited to our account without any deductions (including bank charges). Payments by check or bill of exchange are not accepted.

Payment in advance is considered to be a bank transfer to the following account

Payment via online payment services such as paypal or similar requires our explicit written consent. We reserve the right to charge the buyer for any fees we incur from such payment services.

The minimum order value is 25.- €. In the case of a lower order value, we will charge an additional 10.- € minimum quantity surcharge as a processing fee for the necessary administrative expenses.

Companies, institutes, etc. known to us can be supplied against invoice with a 30-day payment term, provided we agree to this type of supply. A right to this type of delivery does not exist, we reserve the right to delivery by advance payment in any case. First deliveries, deliveries to private persons or to non-german destinations require always prepayment.

Retention of title
In any case, the delivered goods remain our property until complete fulfillment of our claims (reserved goods). Claims arising from any resale of the goods delivered by us are assigned to us. The customer is authorized to sell the goods belonging to us in the ordinary course of business, but not to pledge or assign them as security. The customer is obliged to inform us immediately of any pledge or other interference by third parties.

Return under the condition of Directive 97/7/EC (distance contracts)
The customer has the right to return the goods within 14 days from the delivery date without any justification. Though the directive applies officially only to buyers living in the European Union I provide this right also to non EU customers. The shipment charges for both direction (from Florian Anwander to the customer and back from the customer to Florian Anwander) are not refunded but have to be payed by the customer (exception: consignments within Germany, for this please refer to the German Geschäftsbedingungen, especially the remarks concerning the Widerrufsrecht).

!!! Excepted from any return are the following articles: custom designs, kits, electronic parts, semiconductors (including integrated circuits), frontpanels, pcbs, special orders, used items like test units or exhibition units, all items that are not in the original conditions (e.g. kits that have already been assembled, used items, dirty items, items with scratches or other mechanical/optical faults, disassembled items, returns with missing add on parts like cables or screws).

Warranty
Florian Anwander Musikelektronik or a representative / authorized dealer warrant the mechanical and electronic components to be free of defects in material and workmanship for a period of 2 years from the original date of purchase, in accordance with the warranty regulations described below. If the product shows any defects within the specified warranty period that are not due to normal wear and tear and / or improper handling by the user, Florian Anwander Musikelektronik or a representative/authorized dealer shall, at their sole discretion, either repair or replace the product or repay the purchase price deducting reasonable charges for the period of usage. If not bought directly from Florian Anwander Musikelektronik the product has to be sent to the representative / authorized dealer where it was purchased. Shipment directly to Florian Anwander Musikelektronik is applicable only if the product was purchased from Florian Anwander Musikelektronik directly. If the warranty claim proves to be justified, the product will be returned to the user freight prepaid. Warranty claims other than those indicated above are expressly excluded.

The product has to be returned in its original shipping carton, together with a copy of the invoice and possibly the return authorization number (in case that the manufacturer, representative/authorized dealer uses the return authorization procedure). Warranty services will be furnished only if the product is accompanied by a copy of the original retail dealer's invoice. Please contact Florian Anwander Musikelektronik or the representative/authorized dealer before returning the product and ask for the respective returning procedure. Shipments without freight prepaid will not be accepted.

Free inspections and maintenance / repair work are excluded from warranty, especially if caused by improper handling of the product by the user.

Also defects caused by normal wear and tear are exluded from warranty. This applies in particular to rotary or slider potentiometers (including special potentiometers like modulation wheels, pitchbenders, joysticks and drawbars), switches, keys, buttons, plugs and sockets (e.g. miniature jack sockets, 1/4" jack sockets, USB and Midi sockets, plugs of patch cables), ribbon cables and similar electro-mechanical parts.

Damages or defects caused by one or more of the following conditions are not covered by this warranty

misuse, neglect or failure to operate the unit in compliance with the instructions given in the user manual
connection or operation of the unit in any way that does not comply with the technical or safety regulations applicable in the country where the product is used
damages or defects caused by force or any other condition that is beyond the control of the manufacturer

Any repair or opening of the unit carried out by unauthorized personnel (including the user) will void the warranty.

If any inspection / repair of the product by Florian Anwander Musikelektronik or his representative / authorized dealer shows that the defect in question is not covered by warranty, the inspection/repair costs have to be payed by the customer.

Products which do not meet the terms of this warranty will be repaired at the buyer's expense. Florian Anwander Musikelektronik or his representative / authorized dealer will inform the customer of any such circumstance. If the buyer fails to submit a written repair order within 4 weeks after notification, the unit will be returned C.O.D. with a separate invoice for the working hours (required to declear that the defect is not covered by warranty), freight and packing. Such costs will also be invoiced when the buyer has sent in a written repair order.

This warranty is extended exclusively to the original buyer (customer of retail dealer) and is not transferable to anyone who may subsequently purchase this product. No other person or company (e.g. retail dealer) shall be entitled to give any warranty promise on behalf of Florian Anwander Musikelektronik.

Failure of Florian Anwander Musikelektronik or his representative / authorized dealer to provide proper warranty service shall not entitle the buyer to claim (consequential) damages. In no event shall the liability of Florian Anwander Musikelektronik or his representative / authorized dealer exceed the invoiced value of the product.
